Hernandez, now 21, pleaded guilty in 2015 to three felony counts of using a child in a sexual performance and was originally scheduled for sentencing in January, according to court documents originally obtained by the online outlet Jezebel. His sentencing was moved to April. Venue owner Clayton Brashear said they focus on the Billboard charts when booking artists. Hernandez's “Gummo” hit No. 5 on Billboard’s Hot R&B/Hip-Hop chart and No. 12 on Billboard's Hot 100. Hernandez's performance is scheduled for March 14 at the popular South Padre Island bar. “Clayton's respects everyone's opinions. However, the 1st Amendment still stands,” he said of the show via text. The show will go on unless cancelled by the artist, Brashear said. At least one other venue has nixed his concert after details of his legal past emerged, and Hernandez has cancelled the European leg of his tour to study for his GED — a requirement of his plea agreement. Hernandez has given details of the 2015 incident that have contradicted court documents. His colorful branding and "scumbag persona is just for shock value," according to a statement given to police on March 5, 2015.
